By downloading, installing, or using Zeph ("the App"), you agree to be bound by these Terms of Service
("Terms") and our Privacy Policy. If you do not agree to these Terms, do not use the App.
Age Requirement: You must be at least 13 years old to use this App. If you are under 18,
you must have parental or legal guardian consent to use the App and agree to these Terms.
Binding Agreement: These Terms constitute a legally binding agreement between you and
Zeph ("we," "us," "our"). By using the App, you represent that you have the authority to enter into this
agreement.
2. Description of Service
Zeph is a fitness weather application that provides general workout timing recommendations based on
weather data. The App analyzes weather conditions and offers suggestions about outdoor exercise timing
for informational purposes only.
Key Features:
- Weather-based workout timing recommendations
- Activity-specific weather analysis (running, cycling, walking, HIIT)
- Daily readiness scores
- Location-based weather data
- Push notifications (optional)
Service Availability: We strive to provide reliable service but do not guarantee
uninterrupted access. The App may be temporarily unavailable due to maintenance, updates, or technical
issues.
3. No Professional Advice
IMPORTANT: Zeph is not a substitute for professional advice.
- The App provides general weather-based recommendations only
- Recommendations are NOT medical, health, or safety advice
- The App does NOT provide professional meteorological forecasts
- You are solely responsible for all decisions regarding outdoor exercise
- Always consult healthcare professionals before beginning any exercise program
- Use your own judgment about weather conditions and personal safety
- The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition
4. Assumption of Risk and Liability Disclaimer
BY USING ZEPH, YOU ACKNOWLEDGE AND AGREE:
4.1 Outdoor Exercise Risks
Outdoor exercise carries inherent risks including but not limited to:
- Injury from weather conditions (heat, cold, lightning, wind, precipitation)
- Dehydration, heat stroke, hypothermia, frostbite
- Slips, falls, accidents
- Exposure to UV radiation and sun damage
- Air quality issues and respiratory problems
- Wildlife encounters
- Traffic and environmental hazards
- Allergic reactions to environmental conditions
- Cardiovascular events
4.2 Weather Data Limitations
- Weather data may be inaccurate, incomplete, or delayed
- Weather conditions can change rapidly and unpredictably
- The App relies on third-party weather data providers (Open-Meteo and others)
- Recommendations are estimates based on algorithmic analysis
- The App cannot predict all weather-related risks
- Local microclimates may differ significantly from reported data
- The App is not a replacement for official National Weather Service alerts
4.3 Personal Responsibility
YOU ASSUME ALL RISKS associated with:
- Using the App's recommendations
- Exercising outdoors in any weather conditions
- Interpreting weather conditions and making safety decisions
- Making decisions about your health, fitness, and safety
- Relying on location services and weather data
- Any injuries or damages that occur during outdoor activities
4.4 Release of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
The App, its developers, operators, owners, employees, contractors, and affiliates ("we," "us," "our")
are NOT LIABLE for any:
- Injuries, illness, disability, or death resulting from outdoor exercise
- Damages from weather-related incidents or conditions
- Inaccurate, incomplete, or delayed weather data or recommendations
- App malfunctions, errors, bugs, or unavailability
- Lost data, missed notifications, or failed alerts
- Decisions made based on App recommendations or information
- Direct, indirect, incidental, consequential, special, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Harm caused by third-party services or data providers
YOU USE THE APP ENTIRELY AT YOUR OWN RISK.
5. No Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED,
INCLUDING BUT NOT LIMITED TO:
- Warranties of merchantability
- Fitness for a particular purpose
- Accuracy or reliability of information or recommendations
- Uninterrupted or error-free operation
- Security of data or systems
- Non-infringement of third-party rights
- That the App will meet your requirements or expectations
We do not guarantee that:
- Weather data will be accurate, current, or timely
- Recommendations will be suitable for your individual needs, health, or fitness level
- The App will function without interruption, errors, or bugs
- Your data will be secure from unauthorized access or loss
- Third-party services will remain available or functional
- Notifications will be delivered on time or at all
6. User Responsibilities
6.1 You Agree To:
- Use your own judgment about outdoor exercise safety at all times
- Check multiple weather sources before outdoor activities
- Monitor actual conditions regardless of App recommendations
- Follow all local weather warnings, advisories, and emergency alerts
- Exercise appropriate caution for your fitness level, health conditions, and experience
- Not rely solely on the App for safety or exercise decisions
- Keep the App updated to the latest version
- Maintain accurate location settings for proper functionality
- Use the App in compliance with all applicable laws and regulations
6.2 You Must NOT:
- Use the App during severe weather emergencies (tornado warnings, flash flood warnings, severe
thunderstorm warnings, extreme heat warnings, blizzard warnings, or other National Weather Service
emergency alerts)
- Ignore official weather warnings or emergency alerts in favor of App recommendations
- Use the App as your only source of weather information or safety guidance
- Hold us responsible for your exercise, health, or safety decisions
- Exercise beyond your physical capabilities based on App suggestions
- Use the App while operating vehicles or machinery
- Disable location services and expect accurate recommendations
- Attempt to access areas of the App not intended for users
- Use the App for any commercial purpose without written permission
6.3 Emergency Situations
In severe or dangerous weather conditions:
- Immediately stop outdoor activity and seek shelter
- Follow official emergency guidance from the National Weather Service, local emergency management, or
other authorities
- Do NOT rely on the App for emergency weather information
- The App is not designed for emergency or life-threatening situations
Severe weather includes but is not limited to: tornadoes, flash floods, severe thunderstorms with
lightning, extreme heat (heat index above 105°F/40°C), extreme cold (wind chill below 0°F/-18°C),
hurricanes, blizzards, ice storms, or any other dangerous conditions.
7. Subscription Terms and Payment
7.1 Subscription Plans
Zeph offers the following subscription options:
- Monthly Subscription: $4.99 USD per month
- Annual Subscription: $39.99 USD per year (approximately $3.33/month)
Prices may vary by region due to currency conversion and local tax requirements. All prices are in U.S.
Dollars unless otherwise stated.
7.2 Free Trial
We may offer a free trial period for new subscribers. If a free trial is offered:
- The trial duration will be clearly stated at signup
- You will not be charged during the trial period
- You must cancel before the trial ends to avoid being charged
- Your subscription will automatically convert to a paid subscription unless canceled
- Free trials are limited to one per user and cannot be combined with other offers
7.3 Auto-Renewal
Your subscription automatically renews unless you cancel at least 24 hours before the end of the current
billing period.
- Renewal charges will be processed within 24 hours prior to the end of your current period
- Your iTunes Account will be charged upon confirmation of purchase
- You will be charged the then-current subscription price for your plan
- The renewal period will match your original subscription period (monthly or annual)
7.4 Managing Your Subscription
To manage or cancel your subscription:
- Open the Settings app on your iOS device
- Tap your Apple ID at the top
- Tap Subscriptions
- Select Zeph
- Tap Cancel Subscription (must be done at least 24 hours before renewal)
Alternative method:
- Open the App Store app
- Tap your profile icon
- Tap Subscriptions
- Select Zeph and manage or cancel
Important: Deleting the App does NOT cancel your subscription. You must manually cancel through
your Apple ID settings.
7.5 Refunds and Cancellations
- All purchases are processed through the Apple App Store
- Refund eligibility is determined by Apple's refund policies
- We do not provide refunds for partial subscription periods
- Canceling your subscription stops future billing but does not refund the current period
- You retain access to premium features until the end of your current billing period
To request a refund, visit reportaproblem.apple.com
7.6 Price Changes
- We reserve the right to change subscription prices at any time
- Price changes will not affect your current subscription period
- You will be notified of price changes at least 30 days in advance
- If you do not agree to a price increase, you may cancel before it takes effect
- Continued use after a price change constitutes acceptance of the new price
7.7 Subscription Termination
We reserve the right to suspend or terminate your subscription if:
- You violate these Terms of Service
- You engage in fraudulent activity
- You abuse or misuse the App or services
- We discontinue the subscription service (with appropriate notice)
If we terminate your subscription for violation of Terms, no refund will be provided.
7.8 Access After Cancellation
- Upon cancellation or non-renewal, you will lose access to premium features
- Your account data may be retained according to our Privacy Policy
- You may re-subscribe at any time at the then-current price
- Previous subscription history does not guarantee the same pricing
8. Third-Party Services
8.1 Weather Data Providers
The App uses third-party weather data providers, including but not limited to Open-Meteo. We are not
responsible for:
- Accuracy, completeness, or timeliness of third-party data
- Availability or reliability of third-party services
- Third-party terms of service, privacy policies, or data practices
- Changes, interruptions, or discontinuation of third-party services
- Any damages resulting from third-party data errors or service failures
8.2 Apple Services
The App is distributed through the Apple App Store and uses Apple services:
- Payments are processed by Apple
- You must comply with Apple's terms and conditions
- Apple is not responsible for the App's functionality or your use of it
- Apple has no obligation to provide support or maintenance for the App
- Apple is not liable for any claims related to the App
8.3 Third-Party Links
The App may contain links to third-party websites or services. We are not responsible for:
- Content, accuracy, or practices of third-party sites
- Privacy policies or terms of third-party services
- Any damages or losses from your use of third-party sites
Your use of third-party services is at your own risk and subject to their terms.
9. Location Data and Permissions
9.1 Location Services
The App requires access to your location to provide accurate weather recommendations. By using the App:
- You consent to collection and use of your location data as described in our Privacy Policy
- You understand location data may be inaccurate or unavailable
- You acknowledge GPS and location services may fail or provide incorrect information
- You remain responsible for verifying your actual location and local conditions
- You can manage location permissions through iOS Settings > Privacy > Location Services
9.2 Location Accuracy
- Location accuracy depends on device capabilities and environmental factors
- Urban areas, buildings, and weather can affect GPS accuracy
- The App may use approximate location when precise location is unavailable
- Weather data is matched to the nearest available weather station
- Local microclimates may differ from the location used for weather data
9.3 Location Permissions
The App requests location permission with the following options:
- "Allow While Using App" (recommended): Location accessed only when App is open
- "Allow Once": Single-use location access (requires re-permission)
- "Don't Allow": App functionality will be severely limited without location access
You can change location permissions at any time in iOS Settings.
10. Notifications and Alerts
10.1 Push Notifications
If you enable push notifications:
- Notifications are recommendations only, not official weather warnings or emergency alerts
- We are not responsible for failed, delayed, or missed notifications
- Notification delivery depends on Apple's push notification service and your device settings
- You should not rely solely on App notifications for safety or planning decisions
- You can disable notifications at any time in iOS Settings > Notifications > Zeph
- Notifications may include workout timing suggestions, weather updates, and App news
10.2 Official Weather Alerts
- Official National Weather Service alerts always take precedence over App notifications
- The App does not replace official emergency alert systems
- Enable government emergency alerts in iOS Settings > Notifications > Government Alerts
- During severe weather, follow official emergency guidance, not App recommendations
10.3 Notification Accuracy
We do not guarantee:
- Timely delivery of notifications
- Accuracy of notification content
- That notifications will be received at all
- That notifications will function on all devices or iOS versions
11. Intellectual Property
11.1 Ownership
All content, features, functionality, design, code, algorithms, branding, and materials in the App are
owned by Zeph and are protected by:
- United States and international copyright laws
- Trademark laws
- Patent laws
- Trade secret laws
- Other intellectual property rights
11.2 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on your personal iOS devices
- Use the App for personal, non-commercial purposes
- Access App features according to your subscription level
11.3 Restrictions
You may NOT:
- Copy, modify, distribute, sell, or lease the App or any portion of it
- Reverse engineer, decompile, or attempt to extract source code
- Remove, alter, or obscure any copyright, trademark, or proprietary notices
- Use the App's name, logo, trademarks, or branding without written permission
- Create derivative works, adaptations, or translations based on the App
- Frame or mirror any App content on other websites or services
- Use automated systems (bots, scrapers) to access the App
- Interfere with or disrupt the App's operation or servers
- Access the App through unauthorized means or bypass security measures
11.4 Trademarks
"Zeph" and the Zeph logo are trademarks of Zeph. You may not use these marks without prior written
permission.
11.5 User Feedback
If you provide feedback, suggestions, or ideas about the App:
- We may use your feedback without any obligation to you
- You grant us a perpetual, worldwide, royalty-free license to use, modify, and implement your
feedback
- We are not obligated to implement any feedback or suggestions
- You waive any rights to compensation for feedback provided
12. User Conduct and Prohibited Uses
12.1 Acceptable Use
You agree to use the App only for lawful, personal, non-commercial purposes consistent with these Terms.
12.2 Prohibited Conduct
You agree NOT to:
- Use the App for any illegal, fraudulent, or unauthorized purpose
- Violate any local, state, national, or international laws or regulations
- Infringe upon or violate our intellectual property rights or the rights of others
- Harass, abuse, threaten, or harm others
- Transmit viruses, malware, or other harmful code
- Spam, phish, or engage in any form of unsolicited communication
- Impersonate any person or entity or misrepresent your affiliation
- Collect or harvest personal information about other users
- Interfere with, disrupt, or damage the App, servers, or networks
- Bypass, circumvent, or attempt to bypass any security measures
- Use the App in any way that could disable, overburden, or impair functionality
- Attempt to gain unauthorized access to any portion of the App or related systems
- Use automated scripts, bots, or scrapers to access the App
- Resell, redistribute, or commercially exploit the App without permission
- Create accounts using false information or automated means
12.3 Enforcement
We reserve the right to:
- Investigate violations of these Terms
- Take appropriate legal action against violators
- Remove or disable access to content or accounts that violate these Terms
- Cooperate with law enforcement authorities
- Terminate or suspend your access without notice for violations
13. Privacy and Data Protection
13.1 Privacy Policy
Your use of the App is also governed by our Privacy Policy, which is incorporated into these Terms by
reference. By using the App, you consent to the collection, use, and sharing of your information as
described in the Privacy Policy.
13.2 Data Security
While we implement reasonable security measures to protect your data:
- We cannot guarantee absolute security
- No method of transmission over the internet is 100% secure
- You use the App at your own risk regarding data security
- You are responsible for maintaining the confidentiality of your device and account
13.3 Your Privacy Rights
Depending on your location, you may have rights under privacy laws such as:
- General Data Protection Regulation (GDPR) - European Union
- California Consumer Privacy Act (CCPA) - California, USA
- Other applicable privacy regulations

14. Termination
14.1 Termination by You
You may stop using the App at any time by:
- Deleting the App from your device
- Canceling your subscription (see Section 7.4)
- Contacting us to request account deletion
Note: Deleting the App does not automatically cancel your subscription.
14.2 Termination by Us
We reserve the right to:
- Suspend or terminate your access to the App at any time, with or without notice
- Modify, suspend, or discontinue the App or any features without notice
- Remove features, change functionality, or alter the App in any way
- Refuse service to anyone for any reason
Reasons for termination may include:
- Violation of these Terms of Service
- Fraudulent, abusive, or illegal activity
- Prolonged inactivity
- Technical or security reasons
- Discontinuation of the App or service
14.3 Effect of Termination
Upon termination:
- Your right to use the App immediately ceases
- You must delete the App from all devices
- We may delete your account and data (subject to our Privacy Policy)
- Sections of these Terms that by their nature should survive (liability disclaimers, indemnification,
dispute resolution) will continue to apply
- No refunds will be provided for terminated accounts (unless required by law)
14.4 Data Retention After Termination
After termination, we may:
- Retain your data as required by law or for legitimate business purposes
- Delete your data according to our Privacy Policy
- Retain aggregated or anonymized data indefinitely
15. Indemnification
15.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless Zeph, its owners, developers, operators, employees,
contractors, affiliates, licensors, and service providers from and against any and all:
- Claims, demands, actions, or lawsuits
- Liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees)
Arising from or related to:
- Your use or misuse of the App
- Your outdoor exercise activities or decisions
- Your violation of these Terms of Service
- Your violation of any rights of third parties
- Your violation of any applicable laws or regulations
- Any content or information you provide
- Your negligence or willful misconduct
15.2 Defense and Settlement
- We reserve the right to assume exclusive defense and control of any matter subject to
indemnification
- You will cooperate fully with our defense of any claim
- You will not settle any claim without our prior written consent
- This indemnification obligation survives termination of these Terms
16. Limitation of Liability
16.1 Maximum Liability Cap
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM
YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF:
- The amount you paid to use the App in the 12 months prior to the claim, OR
- $50 USD
This limitation applies regardless of the legal theory of liability (contract, tort, strict liability,
negligence, or otherwise).
16.2 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Loss of use or interruption of service
- Cost of substitute goods or services
- Personal injury, death, or property damage
- Emotional distress or reputational harm
- Any damages arising from weather-related incidents or outdoor exercise
- Any damages from inaccurate data, recommendations, or notifications
- Any damages from third-party services or content
This limitation applies even if:
- We were advised of the possibility of such damages
- A remedy fails of its essential purpose
- The damages were foreseeable
16.3 State-Specific Limitations
Some states do not allow the exclusion or limitation of certain warranties or damages. In such states:
- The above limitations may not apply to you in full
- Our liability will be limited to the maximum extent permitted by applicable law
- You may have additional rights under state law
16.4 Basis of the Bargain
These limitations are a fundamental element of the basis of the bargain between you and us. The App would
not be provided without these limitations.
17. Dispute Resolution and Governing Law
17.1 Governing Law
These Terms and any disputes arising from or related to the App shall be governed by and construed in
accordance with the laws of the State of California, United States, without regard to its conflict of
law provisions.
The United Nations Convention on Contracts for the International Sale of Goods does not apply.
17.2 Jurisdiction and Venue
You agree that:
- Any legal action or proceeding must be brought exclusively in the state or federal courts located in
San Francisco County, California
- You consent to the personal jurisdiction of such courts
- You waive any objection to venue in such courts
- You waive any claim that such courts are an inconvenient forum
17.3 Informal Dispute Resolution
Before filing any legal action, you agree to:
- Contact us at legal@getzeph.com with a detailed description of
the dispute
- Provide your name, contact information, and account details
- Describe the specific relief you are seeking
- Allow us 30 days to respond and attempt to resolve the dispute informally
This informal dispute resolution process is a prerequisite to any formal legal action.
17.4 Binding Arbitration
If informal resolution fails, you agree that any dispute shall be resolved through binding arbitration
rather than in court, except:
- Small claims court actions (disputes under $10,000 in most states)
- Injunctive or equitable relief to protect intellectual property rights
- Disputes that cannot be arbitrated under applicable law
Arbitration Terms:
- Arbitration shall be administered by the American Arbitration Association (AAA) under its Consumer
Arbitration Rules
- Arbitration shall take place in San Francisco, California, or remotely by video conference
- The arbitrator's decision shall be final and binding
- Each party shall bear their own costs and fees (unless otherwise required by law)
- The arbitrator may award attorneys' fees to the prevailing party if permitted by law
To begin arbitration:
- Send a demand for arbitration to legal@getzeph.com
- File with AAA according to their rules
- Include all required documentation and filing fees
17.5 Class Action Waiver
YOU AGREE THAT:
- Any arbitration or legal action shall be conducted on an individual basis only
- You waive any right to participate in a class action lawsuit, class arbitration, or representative
action
- Claims cannot be consolidated with claims of other users
- You cannot act as a class representative or participate as a member of a class
If the class action waiver is found invalid or unenforceable:
- The arbitration agreement shall be null and void
- Any class action must be brought in court (not arbitration)
- The dispute resolution provisions of Section 17.3 still apply
17.6 Opt-Out of Arbitration
You may opt out of the arbitration agreement by:
- Sending written notice to legal@getzeph.com within 30 days of first using
the App
- Including your name, address, and a clear statement that you wish to opt out of arbitration
Opting out only affects the arbitration agreement; all other Terms still apply. If you opt out, disputes
will be resolved in court according to Section 17.2.
17.7 Exceptions to Arbitration
The following disputes are not subject to arbitration:
- Disputes qualifying for small claims court (if pursued in small claims court)
- Requests for injunctive relief to protect intellectual property
- Disputes that cannot be arbitrated under applicable law
17.8 International Users
If you are located outside the United States:
- These Terms are still governed by California law
- You may have additional rights under local consumer protection laws
- Mandatory local laws will apply where they cannot be waived
- Disputes may be subject to local dispute resolution requirements
European Union Users:
- You may have rights under EU consumer protection laws
- Nothing in these Terms limits your rights under EU Directive 93/13/EEC or local implementing laws
- You may bring claims in your country of residence if permitted by EU law
18. Changes to Terms
18.1 Right to Modify
We reserve the right to update, modify, or replace these Terms at any time, at our sole discretion, for
any reason, including but not limited to:
- Changes in applicable laws or regulations
- Updates to App features or functionality
- Changes in business practices or policies
- Clarifications or corrections to existing Terms
18.2 Notification of Changes
When we make changes to these Terms:
- We will update the "Last Updated" date at the top of this document
- We may notify you through the App, via email, or by other reasonable means
- Material changes may be highlighted in the notification
- Continued use after notification constitutes acceptance of the modified Terms
18.3 Your Acceptance
- You are responsible for reviewing these Terms periodically
- Your continued use of the App after changes are posted constitutes acceptance of the modified Terms
- If you do not agree to the modified Terms, you must stop using the App and cancel your subscription
18.4 Material Changes
For material changes that significantly affect your rights or obligations:
- We will provide at least 30 days' notice before the changes take effect
- You may cancel your subscription without penalty during this notice period
- If you do not cancel, you will be deemed to have accepted the changes
19. Severability
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or
unenforceable:
- The remaining provisions shall continue in full force and effect
- The invalid provision shall be modified to the minimum extent necessary to make it valid and
enforceable
- If modification is not possible, the invalid provision shall be severed from these Terms
- The invalidity of one provision does not affect the validity of the remaining Terms
20. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or policies
published in the App, constitute the entire agreement between you and Zeph regarding your use of the App
and supersede any and all prior or contemporaneous agreements, communications, or understandings,
whether oral or written.
This entire agreement includes:
- These Terms of Service
- Our Privacy Policy
- Any additional terms presented during signup or feature use
- Apple's App Store Terms and Conditions (as applicable)
No other agreements apply unless specifically agreed to in writing by an authorized representative of
Zeph.
21. Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or
any other provision. Any waiver of any provision of these Terms will be effective only if in writing and
signed by an authorized representative of Zeph.
Specifically:
- Failure to act on a violation does not waive our right to act on subsequent violations
- Delay in enforcement does not waive our enforcement rights
- Waiver of one breach does not waive any other breach
- All rights and remedies remain available unless explicitly waived in writing
22. Assignment
22.1 Your Rights
You may not assign, transfer, or delegate these Terms or your rights and obligations under these Terms
without our prior written consent. Any attempted assignment in violation of this section is void.
22.2 Our Rights
We may assign, transfer, or delegate these Terms and our rights and obligations at any time without
notice or consent, including to:
- Affiliated companies or subsidiaries
- Acquirers in the event of a merger, acquisition, or sale of assets
- Third-party service providers or contractors
23. Force Majeure
We shall not be liable for any failure or delay in performance of the App or our obligations under these
Terms due to causes beyond our reasonable control, including but not limited to:
- Acts of God (earthquakes, floods, storms, natural disasters)
- War, terrorism, civil unrest, or armed conflict
- Government actions, laws, regulations, or orders
- Labor disputes or strikes
- Internet or telecommunications failures
- Power outages or utility failures
- Third-party service provider failures (including weather data providers)
- Cybersecurity incidents or attacks
- Pandemics or public health emergencies

The App may be subject to U.S. export control laws and regulations. You agree to comply with all
applicable export and import laws and regulations. You represent and warrant that:
- You are not located in a country subject to U.S. government embargo or designated as a "terrorist
supporting" country
- You are not listed on any U.S. government list of prohibited or restricted parties
- You will not use the App for any purposes prohibited by U.S. law, including development of weapons

27. Apple-Specific Terms
27.1 Acknowledgment
These Terms are between you and Zeph only, not with Apple Inc. ("Apple"). Zeph, not Apple, is solely
responsible for the App and its content.
27.2 Scope of License
Your license to use the App is limited to a non-transferable license to use the App on Apple-branded
products you own or control and as permitted by Apple's App Store Terms of Service.
27.3 Maintenance and Support
Zeph is solely responsible for providing maintenance and support services for the App as specified in
these Terms. Apple has no obligation to provide any maintenance or support services.
27.4 Warranty
Zeph is solely responsible for any product warranties, whether express or implied by law. In the event of
any failure of the App to conform to any applicable warranty:
- You may notify Apple for a refund of the purchase price (if any)
- Apple has no other warranty obligation with respect to the App
- Any claims, losses, liabilities, damages, costs, or expenses attributable to warranty failure are
Zeph's responsibility
27.5 Product Claims
Zeph, not Apple, is responsible for addressing any claims relating to the App or your use of it,
including:
- Product liability claims
- Claims that the App fails to conform to legal or regulatory requirements
- Claims arising under consumer protection or similar legislation
27.6 Intellectual Property Claims
In the event of a third-party claim that the App infringes that third party's intellectual property
rights:
- Zeph, not Apple, is responsible for investigation, defense, settlement, and discharge of such claim
- Apple has no obligation or liability for such claims
27.7 Third-Party Beneficiary
Apple and Apple's subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of
these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these
Terms against you as a third-party beneficiary.

28. Acknowledgment and Acceptance
BY USING ZEPH, YOU ACKNOWLEDGE THAT:

- ✅ You will not hold us liable for weather-related incidents, injuries, or damages

- ✅ Weather recommendations are general guidance only, not professional advice
- ✅ You will use multiple sources for weather information and safety decisions
- ✅ Official weather warnings and emergency alerts supersede App recommendations
- ✅ You understand the App is provided "as is" without warranties
- ✅ You agree to binding arbitration and waive class action rights (unless opted out)
- ✅ You are at least 13 years old (or have parental consent if under 18)
- ✅ Your subscription will auto-renew unless canceled 24 hours before renewal
